EKITI ON MY MIND, There is no doubt that EKITI has been a centre for catalytic actions in the history of this nation called Nigeria. The Ironsi-Fajuiyi Story a debacle that contributed to no small measure in our history has a link to this State. Today Ekiti will play another great role in shaping our jurisprudence when the Opposition Party APC and The PDP will battle it out in a legal tussle of wits in respect of the recently concluded election in the State wildly believed to have been won by the Peoples Democratic Party PDP. The opposition Party is alleging irregularities and intimidations based on the massive deployment of military men during the election and other electoral malpractices which the onus will be on them (prosecutions) to prove before the learned juries, going by the legal maxims ( affirmanti, non naganti, incumbit probatioo) He who asserts must prove. No doubt it is going to be very interesting case as the incumbent opposition party governor has already conceded victory to the elected governor by openly congratulating him, an action which his party has condemned and has petitioned the State Electoral tribunal rejecting the Election out rightly. Whether or not the party has the locus stadi to challenge that Election will be the decision of a court of competent jurisdictions, what ever way it will be, which ever side it goes one thing is certain a new judicial precedence is in the making, after this case our jurisprudence will never be the same again. Ekiti again will be making a great contributions in our legal history, it is just a matter of time. The decisions in AMECHI v INEC may play a vital role in this case.
