EWS ADVISORY 19 September 2013 Recruiter penalized for failure to fulfil settlement agreement Administrator Hans Leo J. Cacdac yesterday ordered the suspension of processing of documents of Access Africa Human Resources after it failed to return the passport of an applicant in compliance with a compromise agreement. Cacdac said Ms. Gerlie R. Sanchez filed a request for conciliation at the POEA Conciliation Unit on August 16, 2013 to recover her passport allegedly being withheld by Access Africa. The two parties entered into a compromise agreement on September 3 wherein Access Africa promised to return the passport of the worker on September 7, 2013. Ms. Sanchez, on September 9, reported to the office of the POEA Administrator that Access Africa failed to comply with its obligation under the agreement and requested imposition of sanction against the agency. Cacdac said Section 3, Rule 2, Part VIII of the 2002 POEA Rules and Regulations mandates that in case of unjustified failure of a licensed recruitment agency to abide by the terms of the approved settlement, the POEA shall suspend processing of its documents until the terms of the compromise agreement has been fully complied. /END poea.gov.ph/news/2013/PR_Sep2013_Access_passport.pdf
