EX TURPI CAUSA NON ORITUR ACTIO(from a dishonourable cause an action does not arise) Justice Adeniyi Ademola of the federal high court Abuja awarded victory to bala james Ngilari to become the new Governor of Adamawa state....my concern is that did justice Ademola gave that judgment under the atmosphere of ignorance or forgetfulness of some deliberate inconsistencies by Bala James Ngilari?? What did our constitution say in section 306....this is it SECTION 306(1,2 and 5)of the 1999 constitution as amended (1) Save as otherwise provided in this section, any person who is appointed, elected or otherwise selected to any office established by this Constitution may resign from that office by writing under his hand addressed to the authority or person by whom he was appointed, elected or selected. (2) The resignation of any person from any office established by this Constitution shall take effect when the writing signifying the resignation is received by the authority or person to whom it is addressed or by any person authorised by that authority or person to receive it. (5) The notice of resignation of the Governor and of the Deputy Governor of a State shall respectively be addressed to the Speaker of the House of Assembly and the Governor of the State. The question is why did the plaintiff (Bala Ngilari) choose to send his resignation to an alien to the law....in the foregoing,a plaintiff wil be unable to pursue legal remedy if it arises in connection with his own illegal act.......please do share your thoughts aswell..thanks
