EYES WIDE OPEN: Many of you have probably already heard about the Decision handed down by the SCOTUS today on the Issue of Affirmative Action. The 7-1 Ruling was to send the case back down to the 5th Circuit Court of Appeals. Justice Clarence Thomas Dissented, and Justice Ruth Bader Ginsburg did not join either side. Instead, she used her Dissent to outline what she thought was key to deciding the Issue. The Issue rests on the idea of Race Neutrality, but Justice Ginsburg makes it clear that she believes (as does BPN) that Race Consciousness and not Race Blindness informs the Process that Fisher (the Plaintiff here) supports. Justice Ginsburg felt that the other Justices "Settled" for a Technical Ruling on the Issue of Affirmative Action, instead of using clear information to close out the Case right now. This Issues will go back to the 5th Circuit and could be brought back to the SCOTUS in the next Session. For now, Affirmative Action has been Preserved, and the Legislation can continue the work of Increasing Access for many. #OpenDoors...
