Legal experts say it is a grave human rights violation. 52-year Abdul Rashid Parray, according to his family, was detained three days ago by a police party and has been held since at Police Station Hajin. According to police, Parray’s son, Zubair Ahmad, was “wanted” in a stone pelting case. Parray’s detention instead of his son, legal experts said, amounts to violation of international and Indian law. Tahira Bano, Parray’s wife, told Greater Kashmir that her husband was picked up by a police party Friday. “They asked him to accompany them to Police Station and talk to officer there,” she said. “But he has been held since. I don’t understand why he has been detained.” She added, “They are looking for Zubair. He is not at home. We have told them go and arrest him. Why have they detained my husband?” According to Tahira, Parray has undergone a couple of surgeries and remains usually ill. “How can they detain an ill person in a police station?” In a nocturnal raid Sunday night, another elderly, Ghulam Muhammad Hakeem, was detained instead of his son, Showkat Hakeem, a separatist leader. Showkat told Greater Kashmir that police raided his home at around 1:30 am and took away his father. “Police can’t arrest anybody except the accused. And if it does, it amounts to gross human rights violation under Indian and international law,” said High Court lawyer, Syed Riyaz Khawar. “It also amounts to violation of state constitution, in fact all laws. Such kinds of detentions are unheard of in legal jurisprudence.” Khawar said those detained instead of others could file a suit against police for an illegal detention. “It is like police taking somebody as hostage instead of somebody else,” he added. Locals said dozens of persons were detained in nocturnal raids across the town ahead of Lok Sabha polls in North Kashmir scheduled for May 7. They alleged forces damaged property worth lakhs of rupees in Wahab Parray Mohalla, Mir Mohalla, Hajam Mohalla and Banger Mohalla. “Cops barged into our houses during night and damaged property,” said a local, Ghulam Rasool Dar. Dar’s carpet worth Rs 4 lakh, which he was sewing, was torn apart by police, he alleged. In other Mohallas, locals said, houses suffered massive damage due to ‘police atrocities.’ In defiance to night raids, locals here remain awake whole night to prevent police from arresting civilians. They keep playing on loudspeakers ‘Nasheed’ throughout the night. ‘Detaining Everyone’ Locals said police were on a detention spree in the town and that they were cracking down on everyone – from students to professionals. “We fear leaving out of our homes,” said a student Younis, who only gave his first name. “We fear going to college and school. They detain everyone.” The nocturnal arrests have triggered a wave of anger across the town. Meanwhile, complete shutdown was observed in the town against detentions and night raids. All shops remained closed while there was thin movement of people on roads. Traffic also remained affected throughout the day. Station House Officer Hajin Ateequallh said “damage might have occurred during detentions.” “These people use loudspeakers throughout the night. We tell them don’t do so. And we are cracking down on them,” he said. “Zubair’s father was held for some time. He has been let out to best of my knowledge,” the SHO claimed. The family however said he has not been freed.
