Edo: Hon. Razak Momoh Regains Freedom After 60 Days in Remand -By Musa Mustafa Jun 22nd, 2013 The state High Court 1 sitting in Auchi, on Thursday, granted the bail application by Hon. Razak Momoh, the member representing Etsako West constituency 1 in the state House of Assembly, after spending 60 days in remand. Justice Ada Ehigiamusoe granted the law-maker bail to the tune of one million naira and two sureties in like sum and landed properties verified within Auchi and must be resident within the Judicial district. The law-maker who was arrested on the 20th of April this year at the Baladi hotel in Aviele was charged with illegal possession of fire arms, an offense punishable under the fire arm act. He was also standing trial for alleged involvement in arm robbery before Magistrate Caroline Nwoha in Auchi magistrate court. Mrs. Nwoha had ordered that the case file be sent to the Director of Public Prosecution and that the accused be remanded in Auchi medium prison pending hearing on June 3. The court could not hear the case on the adjourned date as Magistrate Nwoha declined to entertain the suit for lack of jurisdiction and the case was subsequently transferred to the high court. Having gone through the bail application by the accused person and the counter affidavit by the prosecutor, Justice Ada Ehigiamusoe said the offense was a bailable one more so as the law-maker owes a duty to serve his constituency. Justice Ehigiamusoe noted that the factors listed for bail by the applicant which include ill-health as a result of his alleged manhandling by the military personnel during his arrest are issues of serious note. She said that she is convinced that the incident was not robbery as there was no one robbed and there was no evidence to show that any such thing happened. She noted that everything that transpired during the incident were election related but was quick to add that those issues will be determined in the substantive suit.
