Elephants, the main focus of the litigation, come away the biggest losers. Elephants suffer in confinement. They form deep personal bonds. They take care of their sick, injured, and assist handicapped family members. They rescue other elephants when they are in trouble. And they will reverently caress the bones of a departed friend even years after their death. They are sentient creatures with a deep inner life. They should not be a tool to “entertain” people for profit. HSUS, the ASPCA, and other plaintiffs use of someone who the court ruled was a paid plaintiff and fact witness who is not credible not only enriches a company at the expense of animals, but it casts a pall over any claims about animals in confinement and used for entertainment, claims which will most likely now face a higher burden of proof in the court of public opinion, if not also the courts.
