Endless rant part 37: The United States Constitution is an outdated document and it needs to be replaced. Because of the dictates of a document written over two centuries ago, it has become nearly impossible to work together to devise significant solutions to many social problems. The authors of the constitution could not have imagined obesity as a health crisis, an American military that actively starts wars, the emergence of two ineffective political parties, and the destructive role of money in running for and holding elected office. The Constitution gives people who live in rural areas excessive political representation in comparison to those who live in cities. The winner-take-all electoral system that is established by the constitution has been gamed and bastardized so badly that we, for all intents and purposes, no longer have competitive elections in much of the country. The Constitution establishes a legal framework for intellectual property rights that is beginning to actively prevent social and economic progress. The original Constitution itself guaranteed few individual rights (these were won through amendments to the document and judicial interpretation). Many of the modern freedoms we hold dear arguably (and actually) have no legal basis in the Constitution as it was written. Ideals like freedom of (and from) religion, freedom of speech, a free press, and personal privacy are all parts of the constitution that are great. We can repeal and replace the US constitution without giving up what’s good about it. The constitution, like the Bible or fairy tales, are written documents that many people like, that is, until the written word in question disagrees with that person’s emotive-based beliefs. I, for one, am honest enough to admit that all humans are willing to warp written law to gain whatever results they are seeking. At this point in our history, the oldest governing document is more of a hindrance than a benefit.
