Enquiring minds... In a Deviation effective March 13, 2014, DoD contracting officers are now being required to make a determination that purchases through GSA Schedules in accord with FAR 15.404-1 are fair & reasonable. This despite the fact that according to FAR 8.404, GSA has already determined the prices of supplies and fixed-price services, and rates for services offered at hourly rates, under schedule contracts to be fair and reasonable. FAR 8.404 goes on to say ordering activities are not required to make a separate determination of fair and reasonable pricing, but because of the new Deviation that provision no longer applies to some DoD agency buys. DoD contends that GSAs determination does not relieve the ordering activity contracting officer from the responsibility of making a determination of fair and reasonable pricing for individual orders, BPAs, and orders under BPAs, using the proposal analysis techniques at 15.404-1.
