Even before the ink that signed the Comprehensive Agreement on the Bangsamoro (CAB) dried, and even before the Bangsamoro Basic Law (BBL) can be filed in and deliberated by Congress, Sen. Miriam Defensor Santiago declared that the Agreement signed recently between the GPH and MILF is UNCONSTITUTIONAL! During her interview which I watched on Channel Net 25 that she was approached by some people about the matter and she intends to file a petition before the Supreme Court to declare it as unconstitutional. In todays issue of Manila Times and the Daily Tribune, Thursday, April 03, their headline reads: CAB IS UNCONSTITUTIONAL - Sen. Santiago. If a petition is filed in the SC, Congress have yet to wait for the decision of the High Tribunal before it can deliberate on it. If the entire Agreement, like the MOA AD, will be declared as unconstitutional, then it will be back to zero and its consequence is regrettable. But if the SC will only declare certain parts or provision of the CAB as unconstitutional, then Congress can deliberate on the Bangsamoro Basic Law (BBL) by harmonizing with the Constitution those provisions declared as unconstitutional.
