Every President since Abe Lincoln has used executive orders as the so-called law of the land; However, under the u.s. constitution, executive orders were designed only as a communication tool to the White House staff and exclusively as orders or information to the Executive Branch. Only the Legislature can write law, because the Constitution explicitly states that all Bills must originate in the House of Representatives, and then be voted on and passed by both Houses--Representative and Senate. The reason Lincoln wrote Executive Orders as law was because the Confederate States walked out of the Congressional session at the start of the Civil War, and this ultimately suspended the U.S. Constitution and the United States Federal Government. You will not learn this in school. During the Civil War, under Lincoln, as the de-facto President of the suspended Union, a state of emergency was declared and Martial Law, or Military Rule, was imposed on the people. This state of emergency and martial law is currently, technically, still in effect to this day, and that is why you see modern day Presidents, every democrat and republican since Lincoln, has issued Executive Orders as law.
