Excellent! We need more of this kind of courage in face of extreme pressure: Judge Griffith... writes that he and Judge Ray Randolph reached their conclusion frankly, with reluctance, given the practical consequences. But, high as those stakes are, the principle of legislative supremacy that guides us is higher still. Within constitutional limits, Congress is supreme in matters of policy, and the consequence of that supremacy is that our duty when interpreting a statute is to ascertain the meaning of the words of the statute duly enacted through the formal legislative process. - Shawn Rogers Additionally, Jonathan Adler and Michael Cannon authored a great Op-ed in todays (7/23) WSJ entitled: Reining in ObamaCare--and the President. Adler and Cannon reiterate the WSJ editorial featured below, however, with greater detail, expressed with simplicity and clarity. As stated: The president supporters have had three years to find such evidence supporting their theory of congressional intent. They have come up empty. But several other issues stand out: Thirty-six states banded together to reject the exchanges. As the minority party in Congress, Republicans have been hamstrung not only by executive overreach, but zombie-like democrat actions to systematically destroy the U.S. Constitution. WE SHOULD NOT FORGET THE POWER OF REPUBLICAN CONTROLLED STATES AND REPUBLICAN GOVERNORS TO HALT FEDERAL ENCROACHMENT. Finally, its no stretch to conclude that the U.S. Court of Appeals, the second highest court in the country, when ruling that the Obama administration broke the law, highlights the continuing controversy surrounding the reasons why Justice Roberts rewrote Obamacare to bypass Congressional funding authority.
