FARM EMPLOYERS SHOULD HAVE WORKERS COMP: Why don’t farmers who hire employees buy WC? The rates have been reduced again in ND even though the maximum base payroll went up from $27,900 to $31,800 as of July 1, 2013. It is more important than ever that farm employers have WC. They protect their entire asset portfolio from any and all legal actions of an injured employee or estate. This is an absolute fault-less system with NO cap on damages. There is no “negligence requirement” as there is in Employer’s Liability. There is no subrogation by a health carrier and now with Obamacare on the horizon, little is known how it will affect farm employers. Farmers and ranchers who hire family can rely on WC benefits from death to rehab, regardless of fault or negligence as a farm employee. Premiums dropped between 5 and 16% for most agriculture classifications. For example, the standard “farming and ranching” classification [0006] has a base rate of $5.29 per hundred payroll with an annual cap of $1,714.02 per employee. This is down from almost $1800 last year. The “commercial farming” classification [0050] has a $4.16 rate with an annual cap of $1,322.88. This is a little over $100 per month per employee for total peace of mind—no legal costs—no court costs—absolute coverage. The “commercial farming” class is defined as custom operations of planting, caring for, harvesting of grain or field crops on a contract basis. The “custom spraying” [ground] has an even lower rate with an annual cap of $795. Employers may split the payroll for employees between two or more classifications, depending upon the type of work and time spent on each classification. Farmers who purchase WC and maintain the policies from year to year also enjoy claim-free premium dividends. In some cases and in some years this has been near 50% which merely cuts the premium in half after the fact. Why don’t farmers manage their employee exposure better?
