Point No 2 : Regarding Recruitment Scam in appointment of Rehabilitation Professionals – Special Education Teachers at Secondary(Class IX-X) / Senior Secondary(XI-XII) Level. Point No 3 : Regarding Cheating of Rs. 14,14,00000/- Rs Fourteen Crore Fourteen Lac Only (Approx.) with Special Education Teachers (Guest Teachers) appointed under the Centrally Sponsored Scheme (CSS) of ‘Inclusive Education of the Disabled at Secondary Stage (IEDSS) Ref: F.No 8-1/2014-RMSA.IV , Govt of India, MHRD, DOSEL, Shastri Bhawan Dated at New Delhi the 02/05/14 Regarding 41 st Meeting of Project Approval Board (PAB) (21 st Composite PAB Meeting) for Rashtriya Madhyamik Shiksha Abhiyan (RMSA) held on 03 rd April 2014 to consider the Annual Work Plan & Budget 2014-15 of Delhi. Annexure- II. Madam / Sir, I humbly submit as under : Brief Facts: That a budget of Rs 34,38,49,400/- has been allotted by the MHRD to the Delhi Government for payment of Salaries of the Rehabilitation Professionals – Special Education Teachers working in the Directorate of Education Govt of NCT of Delhi under the Centrally Sponsored Scheme (CSS) of ‘Inclusive Education of the Disabled at Secondary Stage (IEDSS) under the Rashtriya Madhyamik Shiksha Abhiyan (RMSA). The Centrally Sponsored Scheme (CSS) of “Inclusive Education of the Disabled at Secondary Stage (IEDSS)” aims to: enable all students with disabilities completing eight years of elementary schooling an opportunity to complete four years of secondary schooling (classes IX to XII) in an inclusive and enabling environment provide educational opportunities and facilities to students with disabilities in the general education system at secondary level (class IX to XII). Under the provisions of Para 5.2.II (vi) of Centrally Sponsored Scheme (CSS) of “Inclusive Education of the Disabled at Secondary Stage (IEDSS)” the Directorate of Education GNCT of Delhi was under obligation to appoint Special Education Teacher covering all disabilities under the age group 14-18 years. And Qualifications of the Special Teachers was mentioned in Appendix – III. Salary of Special Education Teachers was prescribed as applicable for general teachers. In addition, a sum of Rs. 400/- per month may be given to these teachers as honorarium under this Scheme. That as per conditions laid by MHRD in Appendix – III of the Centrally Sponsored Scheme (CSS) of “Inclusive Education of the Disabled at Secondary Stage (IEDSS)” regarding appointment of Special Teachers : Any school where the number of the children with disabilities is more than 5 should appoint one special educator. In accordance with this ratio the requisite number of special teachers may be appointed in schools ( or for a cluster of schools) for children requiring special teacher support on permanent basis. The same teacher will provide counseling to the parents, help in identifying the needs of children with disabilities and resources therefore, participate in the assessment team, help in training programmes and in other ways whenever necessary. Qualifications of the Special Teachers (iv) Graduates with B.Ed. (Special Education) or B.Ed. (general) with a 2 years Diploma in Special Education for Class IX & X. (v) Post Graduates in relevant subject with B.Ed. (Special Education) or B.Ed. (general) with a 2 years Diploma in Special Education for Classes XI & XII. (vi) Teachers with Qualifications in single disability area will be encouraged to specialize in other disability areas to take care of wide range of diversities in a general school. (vii) Prescribed qualifications should be adhered to. In case qualified special teachers are not available, teachers with short training courses recognized by the Rehabilitation Council of India (RCI) may be appointed with the condition that they will complete the full course within three years of appointment. Special Allowance for these teachers will be admissible only after completion of the full course. Remuneration : The salary of special teachers will be as applicable to general school teachers of the corresponding category in that State / U.T. Considering the special type of duties, these teachers will also be given a special allowance. The State Government may recruit such teacher for this purpose following the normal recruitment procedures. That the Rehabilitation Council of India (RCI) is a A Statutory Body under the Ministry of Social Justice & Empowerment constituted by an enactment of Parliament, RCI Act 1992. And the preamble of the said Act empowers the RCI to regulate the training of rehabilitation professionals and maintenance of Central Rehabilitation Register and matters connected therewith. Section 2 (n) of the Act provides the list of the professionals for whom the RCI will develop and standardize the professional courses with the objective of minimum standard of education and to maintain the Central Rehabilitation Register of such professionals. The Special Education Teachers is one of the category of RCI registered professionals. That in accordance with the provisions of Centrally Sponsored Scheme (CSS) of “Inclusive Education of the Disabled at Secondary Stage (IEDSS Scheme) the RCI who is the competent authority has also developed the guidelines for minimum requirement of RCI approved qualification for appointment of Special Education Teachers. The LATEST guidelines are published vide RCI Letter No 7-91/RCI-2011 Dated 11.01.12. The Minimum requirement of RCI approved qualification for appointment of Special Education Teachers for Level III – Secondary and Senior Secondary (Class IX to XII) is as under: Education Teachers is read as under: Level Minimum Academic and Professional Qualification Pre School / Nursery / Play School 1.Xth Class passed and Certificate Programme in in Early childhood Special Education Or 2. XIIth passed and One year Diploma Programme in Early Childhood Special Education DECSE-MR / DECSE-VI Of 3. XIIth passed and Diploma in Teaching Young Children (Deaf and Hard of Hearing) Or 4. Xth Class passed and Certificate in Care Giving Programme. Or Any other equivalent qualification approved by RCI Elementary (Primary/Upper Primary) 1.XII passed and two year D.Ed. Special Education in any of the category of disability Or 2. XIIth passed and one year Diploma in Special Education (DSE) in any of the category of disability Or 3. Diploma in Community Based Rehabilitation (DCBR) with 6 months Certificate course in Education of Children with Special Needs Or 4. Post Graduate Diploma in Community Based Rehabilitation (PGDCBR) with 6 months Certificate course in Education of Children with Special Needs Or 5. Diploma in Multi Rehabilitation Worker (MRW) with 6 months Certificate course in Education of Children with Special Needs Or 6. Junior Diploma in Teaching the Deaf 7. Primary level Teacher Training course in Visual Impairment Or 8. Diploma in Vocational Rehabilitation – Mental Retardation (DVR-MR)/Diploma in Vocational Training and Employment – Mental Retardation (DVTE-MR) with 6 months Certificate course in Education of Children with Special Needs Or 9. Diploma in Hearing Language and Speech (DHLS) with 6 months Certificate course in Education of Children with Special Needs Or 10. XII passed with any RCI recognized qualification of minimum one year duration and 6 months Certificate course in Education of Children with Special Needs Or Any other equivalent qualification approved by RCI Secondary and Senior Secondary 1.Graduate and B.Ed. (Special Education) Or 2. B.Ed.(General) with one year Diploma in Special Education Or 3. B.Ed.(General) with two years Diploma in Special Education. 4.B.Ed. (General) with Post Graduate Professional Diploma in Special Education (PGPD) or 5. B.Ed. Special Education and Post Graduate Professional Certificate in Special Education (PGPC) Or 6. PG Diploma in Special Education (Mental Retardation) 7. PG Diploma in Special Education Multiple Disabilty, Physical & Neutological) Or 8. PG Diploma in Special Education (Locomotor Impairment and Cerebral Palsy) 10. Secondary level Teacher Training Course in Visual Impairment Or 11. Senior Diploma in Teaching the Deaf Or 12. BA B.Ed. in Visual Visual Impairment Or Any other equivalent qualification approved by RCI. That the Recruitment Rules of Directorate of Education vide Gazette Notification dated 04/11/2010 also commensurate with the above qualification of IEDSS and RCI. As per the Recruitment Rules the Essential Qualification for the post of Special Education Teacher is as under: Essential: Graduate with B.Ed. (Special Education) or B.Ed. with a two years diploma in special education or post – graduate professional diploma in special education. OR Any other equivalent qualification approved by the rehabilitation council of India. Note: Teacher with qualification in single disability area will be encouraged to specialize in other disability areas by undergoing modular courses to take care of wide range of diversities in a General School. Point No. 1 : Regarding Scam of funds of Rs. 34,38,49,400/- (Thirty Four Crore Thirty Eight Lac Forty Nine Thousand Four Hundred Only) granted for the payment of Salaries of Special Education Teachers. The Directorate of Education Govt of NCT of Delhi has received / is receiving Rs. 34,38,49,400/- but it has not made appointments of Secondary(Class IX-X) / Senior Secondary(XI-XII) Level - Special Education Teachers. Kindly refer to Lr. No F.DE.4(e)330/SET/E-IV/10/262 Dated 15/10/2012 addressed to the Dy Secretary (P&P), DSSSB, Delhi 110092 (Annexure – I ) whereby the Directorate of Education Govt of NCT of Delhi had sent Requisition for filling 927 vacancies of Special Education Teachers . The vacancies were for Elementary – Primary (Class I-V) & Upper Primary (Class VI- VIII) & and CTET was made essential. Thus it is proved that the Directorate of Education is receiving funds under Centrally Sponsored Scheme (CSS) of ‘Inclusive Education of the Disabled at Secondary Stage (IEDSS) under the Rashtriya Madhyamik Shiksha Abhiyan (RMSA) and diverting it to Elementary level – Primary – (Class I-V) and Upper Primary (Class VI-VIII). Hence the purpose of Centrally Sponsored Scheme (CSS) of ‘Inclusive Education of the Disabled at Secondary Stage (IEDSS) under the Rashtriya Madhyamik Shiksha Abhiyan (RMSA) is totally deceived. Point No. 2 : Regarding Recruitment Scam in appointment of Rehabilitation Professionals –Special Education Teachers at Secondary(Class IX-X) / Senior Secondary(XI-XII) Level. That in accordance with the provisions of Centrally Sponsored Scheme (CSS) of “Inclusive Education of the Disabled at Secondary Stage (IEDSS Scheme) the RCI who is the competent authority has also developed the guidelines for minimum requirement of RCI approved qualification for appointment of Special Education Teachers. The LATEST guidelines are published vide RCI Letter No 7-91/RCI-2011 Dated 11.01.12. as mentioned above. But in the DSSSB advertisement 01/2013 Post Code 01/13 and DSSSB advertisement 01/14 Post Code 146/14 completely violated the guidelines of the RCI. The Directorate of Education thorough DSSSB made following essential qualification: (i) Graduate with B.Ed. (Special Education) or B.Ed. with a two years Diploma in Special Education or Post Graduate Professional Diploma in Special Education OR any other equivalent qualification approved by Rehabilition Council of India. (ii) Central Teacher Eligibility Test (CTET) conducted by CBSE. R.No. D/ADAE/TRC/Edu./HQ/2012./1594 dated 19/1/2012. The Directorate of Education with fraudulent intention didn’t mention the Level for which the appointment were to be made ie for Elementary or for Secondary / Senior Secondary. If the appointment were made for Elementary Level then why B.Ed. Special Education Qualification was made essential and why the D.Ed. Special Education were excluded. If the appointment were made for Secondary / Senior Secondary Level then why CTET was made compulsory. The Directorate of Education with fraudulent intensions intermix the qualification of two levels : CTET which is only required for Elementary Level ( Not required in case of Special Teachers) and B.Ed. (Special Education) which is required only for Secondary / Senior Secondary Level. The Directorate of Education knowingly violated the provisions of Centrally Sponsored Scheme (CSS) of “Inclusive Education of the Disabled at Secondary Stage (IEDSS)” , RCI Guidelines regarding minimum qualifications for Special Education Teachers and Recruitment Rules duly published in the Delhi Gazette on behalf of Hon’ble Lt. Governor of Delhi. The Directorate of Education has been successful in its motive and only 227 Special Education Teachers were appointed and most of the vacancies remain vacant. The eligible candidates were ousted from the selection process and the ineligible candidates were recruited. Point No 3 : Regarding Cheating of Rs. 14,14,00000/- Rs Fourteen Crore Fourteen Lac Only (Approx.) with Special Education Teachers (Guest Teachers) appointed under the Centrally Sponsored Scheme (CSS) of ‘Inclusive Education of the Disabled at Secondary Stage (IEDSS) Under the provisions of Para 5.2.II (vi) of Centrally Sponsored Scheme (CSS) of “Inclusive Education of the Disabled at Secondary Stage (IEDSS)” the Directorate of Education GNCT of Delhi was under obligation to appoint Special Education Teacher covering all disabilities under the age group 14-18 years. And Qualifications of the Special Teachers was mentioned in Appendix – III. Salary of Special Education Teachers was prescribed as applicable for general teachers. In addition, a sum of Rs. 400/- per month may be given to these teachers as honorarium under this Scheme. After ousting the eligible candidate from the selection process and recruiting ineligible candidates the Directorate of Education didn’t stop. They appointed Special Education Teachers (Guest Teachers) in a rate of Rs 700/- per day subject to maximum of Rs 17500/- per month. The such Special Education Teachers (Guest Teachers) were/are not paid for Sundays/Gazetted Holidays. The Special Education Teachers (Guest Teachers) are Rehabilitation Professionals duly registered in CRR , but they earn 15000/- per month (approx.) or Maximum Rs 115000/- to 120000/- in 8 months. The Special Education Teachers (Guest Teachers) are not even paid their Special Pay @ Rs 400/- per month. The Directorate of Education is receiving Rs 326000/- + 3200 = 329000/- per Special Education Teachers (Guest Teachers) but paying only about Rs 115000/- to Rs 120000/- The rest of fund received from the MHRD is appropriated by the Directorate of Education authorities. Prayer: I humbly pray all concerned : To probe an inquiry. To cancel the appointments of 227 Special Education Teachers through DSSSB Advt 01/13 Post Code 01/13 made in violation of Rules. To stay the recruitment process of 720 Special Education Teachers through DSSSB Advt 01/14 Post Code 146/14. To held fresh recruitment separately for Elementary and Secondary / Senior Secondary Level of Special Education Teachers in accordance with the Govt Rules. To take stern action against the officers who have masterminded and executed the Scam. To file a register criminal case under the relevant sections of IPC against the faulty officers who have misappropriated the Govt money. To recover the misappropriated money from the faulty officers. To pay the arrear of pay to Special Education Teachers (Guest Teachers) who worked in 2013-14 and 2014-15. To pay the arrear of Special Pay @ Rs 400/- Special Education Teachers (Guest Teachers) who worked in 2013-14 and 2014-15. You are humbly requested to take appropriate action within 7 days failing which I shall be constrained to represent the matter to the Central Vigilance Commission / CBI, Comptroller and Auditor General of India, PMO and to the Competent Court of Law. If you don’t take cognizance of the case then the direct involvement of MHRD in the above Scam will be presumed.
