FORMER APD OFFICER CONVICTED OF BEATING SUSPECT Officer Had Record of Complaints and Another Citizen Beating Captured on Videotape Atlanta- Fulton County District Attorney Paul L. Howard, Jr. announces a conviction by jury trial in the brutality case involving a former Atlanta Police Officer. Jurors returned guilty verdicts Friday afternoon against 32-year-old Nicholas Dimauro on charges of Aggravated Battery, Aggravated Assault and Violation of Oath by a Public Officer in connection with the violent beating of an alleged suspect, Robert Wormley. The incident happened in the early morning hours of September 4, 2010. Officer Dimauro stopped Mr. Wormley at the intersection of Commercial Avenue and OldKnow Drive in Atlanta as the victim was walking home. Officer Dimauro demanded Mr. Wormley’s identification but the victim refused. The Officer then ordered Mr. Wormley to place his hands on the police vehicle. Mr. Wormley once again refused and turned to run away. Soon after, Defendant Dimauro apprehended the victim and began striking Mr. Wormley across the head with his police baton. The victim and Officer then became engaged in a pattern wherein the victim would break free and run. The officer would then apprehend the victim and once again strike him. Mr. Wormley eventually ran behind a house where the Officer continued beating the victim, repeatedly kneeing him in the side and striking him throughout his body. A resident of the home witnessed the final series of attacks which left the victim with serious injuries including a broken arm, two broken ribs, a collapsed lung and a large gash across his head requiring four staples. Two of the victim’s teeth were also broken. In addition to evidence in this case, jurors also heard evidence from a separate incident involving Officer Dimauro in which another alleged suspect was beaten by the officer after running away. That incident was captured on videotape and played for the jury. Following his conviction, Defendant Dimauro was sentenced to five years in prison and five years’ probation by presiding Fulton County Superior Court Judge Kelly Lee Ellerbe. The case was prosecuted by Deputy District Attorney Melissa Redmon, head of the Public Integrity Unit, with assistance from Senior ADA Brian Ross and DA Investigator Benjie Fennell.
