Filed Application today at High Court in order to help High Court to pass a correct order... ( I can only hope ) Indur. K. Chhugani ...Petitioner -Versus - Punjab National Bank and Ors ...Respondents SYNOPSIS The instant Application is connected to Criminal Writ Petition 2561 of 2013 which is for setting aside the order dated 12.12.2005 of this court in ‘Criminal Application 7912 of 2005 filed in Criminal Writ Petition 2414 of 2005’ as the said order is obtained by fraud played on the court and is void ab initio. The Hon’ble High Court could never have passed this order in the present form, had the respondents been directed to file their Affidavits in reply to the Criminal Application 7912 of 2005 in CrWP 2414 of 2005. The Respondents have repeatedly mislead the courts and Applications are also pending since 13.12.2005 in the Special MPID Court, for action against the same respondents, for having mislead the MPID court. So that once again, these respondents do not resort to tactics adopted on 12.12.2005, applicant has prayed to this Hon’ble Court to direct respondents to file their affidavit in reply, regarding issues detailed in CrWP 2561 of 2013. Points to be urged:- 1. This Hon’ble High Court has wide powers to ferret out the truth and these respondents have earlier disregarded orders of this Hon’ble High Court to file their Affidavit in reply and got away with it. 2. These Respondents have successfully played a fraud on this Hon’ble Court earlier in 2005, by making false oral submissions and it is important to ensure they do not succeed in such misdeeds again.
