Filed in 2004, Ezequiel Castillo alleged a design defect in his Ford Explorer’s roof and its handling led him and his passengers to become injured after a rollover accident. While the jury was deliberating in the rollover trial, the jury forewoman sent a note to the court that asked, “What is the maximum amount that can be awarded?” As a result, the parties immediately settled. Ford attorneys then talked to members of the jury after the settlement was reached. They were told that most of the jurors had favored Ford, and that the presiding juror sent the note to the judge over the objections of her colleagues. The presiding juror left after the trial and was not interviewed by Ford.
