Firm challenges demand for data November 26, 2013 - 5:20pm By BRUCE ERSKINE BUSINESS REPORTER Lawyers for a Calgary seismic survey company argued in court Tuesday the Canada-Nova Scotia Offshore Petroleum Board doesn’t have the authority to demand information it considers proprietary property. Geophysical Service Inc. has applied for a Nova Scotia Supreme Court order declaring that the regulatory board’s demand that the company provide it with all records of non-exclusive seismic survey work it has done off Nova Scotia is not authorized. The company cites the Canada-Nova Scotia Offshore Petroleum Resources Accord Implementation Act and the Canada-Nova Scotia Offshore Petroleum Resources Accord Implementation (Nova Scotia) Act. The application, which also names the attorneys general of Nova Scotia and Canada as respondents, also asks for a permanent injunction preventing the board “from disclosing or otherwise making available to any person whatsoever, and in any manner or format whatsoever, the complete records, or alternatively the electronic records.” Geophysical claims that data produced from non-exclusive surveys from 1971 to 2006 are proprietary, confidential, copyrighted and constitute trade secrets. Geophysical lawyer Will Moreira argued that the regulations govern the provision of data by petroleum exploration companies related to safety, environmental protection, production and conservation. Moreira said his client is not a petroleum producer and that it licenses the seismic information it gathers in order to make money. Geophysical argues that the board has used the information to promote offshore development in Nova Scotia, which it says is far removed from any regulatory requirements. Justice J. Allan Boudreau reserved his decision on the application. Geophysical has launched lawsuits against exploration companies, including Corridor Resources Inc. of Halifax, for allegedly using proprietary seismic data complied for government regulatory bodies without authorization or payment. thechronicleherald.ca/business/1170171-firm-challenges-demand-for-data
