First of all, I wish to establish that this paper is the sole opinion and belief of Gary J Smith. It is the belief of this author that American disabled citizens are being treated unequally juxtaposition of other American citizens. It is true, that disabled Americans have their limitations and this should be considered in any career path, educational endeavor or task that is pursued by this race of people. However this does not and should not infringe on the rights of disabled Americans as it currently does. There have been American patriots that were disabled and American presidents that were disabled, that have done great things for this country. It is therefore my intention and with the utmost fervor, that I spent the rest of my life equalizing a place of disabled people across the world. I would like to establish as a disabled American myself, that we in fact are a race of people and should be recognized as such under the laws of this land. Some of us are born with this condition and others acquire this condition through their lifetime endeavors. Although this is the case, we should not fail to recognize that they are people and should have equal rights everywhere. I understand that the current laws that are in effect to in fact assist disabled Americans in many situations. However, there is still a major deficiency in the inequality amongst disabled Americans, examples of this, to join the military and fight for this great country. As a race, there are many positions that would enable us to serve our country in the United States military; this should not be ignored, including the right to carry a firearm. There are many paraplegic citizens that can still handle a firearm in spite of their disability. In addition to this right, the right to join the police department or the firefighters of this great country, of course there will be limitations to their abilities as with everybody, but they should still be allowed to serve in some capacity because this is the basic rights as American citizens and should not be denied. I, myself, was discriminated against and though I have dealt with this on many occasions throughout my entire life, I never felt that more strongly than ever before is when I worked for the United States Social Security administration. This agency through their dubious practices and procedures forced me to retire from my career against my own wishes. If I had not retired, I would have been forced to stay in my current position as a Service Representative for the rest of my career and never having the right to be promoted as my peers were. This is a fact amongst disabled Americans serving in the Social Security Administration and in fact has been brought up as an issue in federal court by many of my peers who are also disabled. While serving as a Service Representative for this agency, I was the Congressional Liaison for the Fontana area and also worked the heaviest workload in my unit, when it came time for promotions they took my Congressional workload away and assigned me another part of the off, which means a smaller part of the workload and promoted another individual in the unit. In addition, when it came to what words they fail to recognize I service to the office for that year. This all occurred because of my frequent sick leave requests due to my disabling condition. At the same time, I also acquired my Masters degree in counseling psychology and still worked a full-time job. I was forced to retire because of this very fact, that I needed to take required days off of my job and I resent this agency for doing so, in spite of my request from my own personal physician to allow it. Why shouldnt we be allowed to continue a career path with the Social Security Administration and be allowed to take days off as needed for our own health and well-being as a disabled person? In spite of the fact that they do assist many Americans in their fight against poverty, it should still be a right to be able to continue to work in spite of your disability. As I have said before, I declare that I will take up this endeavor till the day I die and promise that I will not stop this resolute endeavor until disabled Americans have been put in the right place as with other American citizens. Amendments Under the current Americans with disabilities act there is no protection for expectant mothers from their employers. In other words they could face adverse action for taking time off from their job to have their baby. Under this new civil rights law it would automatically protect expectant mothers, sick employees and the elderly from receiving some type of adverse action from their employer. In addition to this, if small businesses could show the federal government that they are unable to make the alterations from their own money due to hardship, then a fun set up by the federal government could be set up to assist with any needed alterations to the buildings and access ways. Also I am asking for a change in the law by the United States federal Census Bureau to include disabled persons as a race and to be covered under all other laws for the purposes of protections of disabled persons provided that they can show the have a medical condition lasting two or more years by a licensed Physicians in their home State.
