Following the success of the Court Appeal by the Marikana Lawyers representing poor families killed by the South African Police Services in August 2012, there is scope for expectation that if the Gauteng Motorists appeal the Supreme Court of Appeal decision giving government and SANRAL a go aheard to implement the e-tolls, that perhaps that decision, too, will be overturned and the whole e-tolls saga will be scrapped in order to allow South Africans to drive and travel freely on the Freeway - to bring the freeways back. If South Africa is to be a truly independent and Constitutional democracy, the law must not just benefit the populace, but Court judges and justices must also be seen and perceived to be discharging the jurisprudence in favour of the man on the street.
