For those in Prof Whartons Criminal Law, I was looking up the footage from R v McSorley (2000) if youre interested. I found the preliminary description of McSorley raising his stick and swinging like a baseball bat a little dramatic, it implies a windup to the swing. Either way obviously his stick should not have been up there but its interesting to watch the footage after reading the case, given the way I pictured it from the courts description of events.
