For those who need proof of the Peach Lakes Board illegal actions we provide the following as the basis for our lawsuit; 1. Peach Lake Farms Protective Covenants: Page 5 Article IV C. (The Board SHALL adopt a proposed budget for the Peach Lake Farms annually) 2. (SHALL provide a summary of the budget to all Owners) 3. (Shall set a date for a meeting of the Owners to consider ratification of the budget not less than fourteen nor more than thirty days after the mailing of the summary) 4. (Unless at that meeting a majority of all Owners reject the budget, the budget is ratified) 5. The Board of Directors have failed to follow the Covenants even with the benefit of paid Counsel to the tune of $18,000.00 paid or owed under contract to the Judy & Judy law Firm over the past three years who have directed the past meetings representing the Board of Directors and not the Owners of the Peach Lake Farms Association. We have a recording of the last meeting for those wishing to hear them ignore the Owners present at that meeting. In 2005 the Peach Lake Farms Association incorporated as a West Virginia Non- Profit Corporation, subjecting the Association to the Rules and Laws of Chapter 31E The Non-Profit Corporation Act, naming the Covenants as the rules under which the Corporation would act. 1. The Non-Profit Corporation Act establishes the conduct of Board Members under the Law and allows Board Members who act against the interest of the Corporation to be punished for their actions in Civil Court. 2. As a legal Corporation subject to these laws and with retained counsel representing them, these are rules which they must follow, and yet have failed to do so. 3. They have failed to file with the State and Federal Government, leaving the Association open to possibly expensive legal action in the future for failing to file yearly tax statements, and when notified of this over the past 3 years have failed to act to correct this liability. We are a group of Owners who want sanity restored to our Association, the roads repaired, culverts fixed, ditch lines installed or repaired properly, the pond restored to allow fishing and recreation for all, to include a fishing pier and picnic tables and grills for the use of all Owners and Guests ($18,000.00 could have done all this and still could). We want a better solution to the School Bus situation, caused by the Boards lack of road repair and complaints from possibly someone on the Board (discovered at the last meeting) Because they have acted against the best interest of the Corporation and Owners they are liable for their actions and must be held to account for them to us the Owners of Peach Lake Farms Association Inc. Please revoke any Proxy you have given them in writing to Judy Conner or Bonnie Martin and let us know you have revoked your proxy. We do not want your proxy, only your good will in supporting us in taking back our little piece of heaven which has been soured by the malicious actions of this out of control Board.
