The particulars of the offence revealed that Alhagie Njie and 78 others sometime in the years 2012 and 2013 in the city of Banjul and diverse places in the Republic of The Gambia, failed to register and pay taxes for their various businesses at The Gambia Revenue Authority (GRA) which causes financial losses to the economy of The Gambia, thereby committed an offense. When the case was mentioned in court, Inspector Camara applied under Section 69 of the Criminal Procedure Code (CPC) for the case to be transferred to the High Court in Banjul since the Lower Court lacks the jurisdiction to try the case. The defence counsels MF Mbaye and MS Sambou did not raise any objection to that effect but MS Sambou, who is the defence counsel for 44th, 45th and 48th accused persons respectively, submitted for her clients who were granted police bail to continue enjoying their bail until the prosecutor is ready with the case, since the court she said lacks the jurisdiction to hear the case. In his ruling, the presiding magistrate said: “I shall declare to consider the issue of bail in the matter and not to interfere with the bail granted to any of the accused persons at the police station”.
