Fracking is not subject to federal environmental regulations like the Clean Water Act and the Safe Drinking Water Act, so enforcement of any remaining environmental protection is left to the states. There are nowhere near enough inspectors to look at every site: "It should be noted that generally the state DEP (Department of Environmental Protection) or DEC (Department of Environmental Conservation) or DEQ (Department of Environmental Quality) or DEQC (Department of Environmental Quality Control) does not have adequate budget or staff to investigate, inspect, or monitor HF wells--especially as they are spreading so rapidly. Exempting HF from federal law leaves this responsibility to the states that have been overwhelmed by the drilling. For example, in New Mexico there are only 18 inspectors to deal with 99,000 gas wells. It’s simply not possible for so few people to track so many wells." -Josh Fox
