From Joan Cooper and David Keller, Friends of Shollenberger: Appeals Court Rejects Communitys challenge to Dutra Asphalt Factory Dear All, We are extremely disappointed by this affirmation of the lower courts ruling and the virtually unlimited deference given by the court to the County. We have not yet fully reviewed the new ruling, and will not comment on its contents and implications until weve had a chance to review it with our attorneys. The Court of Appeals apparently decided that the approvals made by Sonoma County Supervisors to place an asphalt plant at the entrance to Petaluma, at the gateway to Sonoma County, along the Petaluma River directly facing Shollenberger Park, were legitimate. We disagree with that conclusion. However, that does not mean in any way whatsoever that the Dutra Asphalt Plant is a good project in this location. The asphalt factory would be a serious and long term affront to the residents, businesses, visitors and environment of our region, and it is tragically misplaced. We gratefully thank the thousands of residents, businesses, concerned citizens and the City of Petaluma, who have strongly and generously supported our collective efforts to stop this disaster over the past years.
