From: Michael Grudecki Sent: Tuesday, November 5, 2013 8:00 AM Cc: City Council Members Subject: RE: Tini Lounge - Batavia City Council Members- Yesterday marks 1 Month since I sent my original email (below) expressing concern regarding the issues I have experienced with the City of Batavia and the RFP process for the City of Batavia owned Thomle building located at 2 East Wilson Street. As a follow-up to my email, I attended a council meeting on Tuesday, October 8th, 2013 where I was left under the impression of the following: 1. A 3rd party was going to be allowed to submit their proposed plan for the Thomle building over 6 months past the RFP deadline (Deadline: February 2013), but was only going to be given 2 weeks to present their plan a. Note: Mr. Bajor and Mr. McGrath stated another 3rd party was excluded around the time of the RFP deadline because the plan was incomplete, yet this plan over 6 months later is being considered? It makes no sense to me and I would like to know why an exception for this particular plan is being made, but the other plan was excluded. It does not seem fair that three organizations were held to written and published RFP deadline and the 3rd party referenced above expresses interest in the property without a formal RFP submission by the deadline and is allowed to be considered. Why have a deadline and what is its purpose if it is not going to be followed? Not to mention another 3rd parties interest in July that was not mentioned until the email below on September 10th, 2013 keeping the 2 organizations abreast of changes/interest. 2. A follow-up would occur and organizations that submitted proposals would be contacted a. Note: My impression based on discussions at the meeting held on Tuesday, October 8th, 2013 was that this would occur approximately two weeks after the meeting. Today marks the 4th week! 3. The discussions regarding the Thomle building would continue on a more regular basis Since the meeting I attended on Tuesday, October 8th, 2013 the following have not occurred: 1. I have heard nothing regarding the “3rd Proposal” and whether or not it is a contender, who is involved, or what the concept is. Additionally, I have went to the cityofbatavia.net website throughout the month to find the plan to compare against what I submitted and have been unable to find the plan. Will this plan be made public and if so, when? 2. No one from the City of Batavia staff has followed-up with Me regarding my submission of the Tini Lounge Proposal for the Thomle building since our discussions on Tuesday, October 8th, 2013 3. I have heard nothing else or seen anything else on the city’s website regarding the Thomle building, status updates, or future meeting being scheduled Now if I have missed something, then I apologize. But to the best of my knowledge all of the above have not occurred which surprises me given the recent article in the Kane County Chronicle that talks about the City of Batavia’s push for businesses that generate sales tax on Randall Road: kcchronicle/2013/10/31/batavia-officials-concerned-about-non-sales-tax-uses-along-randall-road/a9uxlho/ I would assume that the desire to have sales tax generating businesses extends beyond the Randall Road corridor and into other wards including Downtown Batavia. If I am wrong, please let me know? As mentioned in my RFP submission and in subsequent meetings since, the Tini Lounge is a concept that will add to the overall City of Batavia’s tax base. Each day we delay in a final decision regarding the Thomle building, we take away one more day of tax revenue that could be generated from this address. Additionally, an email below written on September 10th, 2013 references “staff will now finalize its memo outlining the potential options with regard to the 2 East Wilson property and present it before the City Council this month” Did this occur and if so, when? That being said, I am making my final request for a more open and timely communication process regarding the Thomle building and the currently open RFP. In closing, one of the Council Members referenced a possible “Pocket Veto” regarding this property and the idea of “Waiting for a better offer”. What this Council Member stated could not be any closer to the way I feel and I would like to be proven wrong regarding these less than positive feelings towards the City of Batavia, staff, and the RFP process.
