From The White House: On March 7, 2013, President Obama signed into law the Violence Against Women Reauthorization Act of 2013 (VAWA 2013). This Act strengthens the Violence Against Women Act with increased protections for Native American women and other victims previously left vulnerable by gaps in the law. During the signing ceremony, the President emphasized in his remarks, “Tribal governments have an inherent right to protect their people, and all women deserve the right to live free from fear.” Accordingly, VAWA 2013 established a voluntary Pilot Project, which authorizes certain tribes to exercise criminal jurisdiction over perpetrators of domestic violence, regardless of their Indian or non-Indian status. The Department of Justice and the Obama Administration are now pleased to release the attached prepublication version of the Notice on the Pilot Project for Tribal Jurisdiction over Crimes of Domestic Violence and a set of Frequently Asked Questions (FAQ) that summarize the Notice. The Notice will be published tomorrow, June 14, 2013, in the Federal Register and will be available on the Federal Register’s website. Please note that this is not a “rulemaking,” but rather a Notice of the proposed procedures for an Indian tribe to request designation as a participating tribe in the voluntary Pilot Project created under the Violence Against Women Reauthorization Act of 2013. The Department of Justice recently hosted tribal consultation sessions and accepted written comments on development of the voluntary Pilot Project.
