I certainly concurred with that statement. Hopefully in my modest contribution I would hope to reverse that trend There is the assertion today promulgated by the media that Israel has stolen the land from the Palestinians. One could argue from a Biblical perspective that Jews were in that land from 3,500 years ago. Although this is true it is quite pointless if people don’t accept this as truth. Or we could argue from archeological angle but here again the Palestinians are actively attempting to destroy any traces of Jewish presence where ever they can in Judea and Samaria. (There are no settlements in Judea, Samaria there are legitimate communities) There must be a better way and there is one… So let’s go back to the court of law, because assertions has been made that Israel stole the Land, let see if this will hold in that court of law! In short Israel is the owner of the Land, they are not occupiers because they have not stolen anything! They have title deeds to the Land from the original two state solution of 1922 League of Nations. That the world community represented in League of Nations approved unanimously. In 1920 after WW1 the Allies had won the war they were free to do what they seem best with the former Ottoman Empire. San Remo of 1920 The mandate was created to end colonialism. Both Lebanon and Syria came into existence has a mandate in this case controlled by France. Iraq, Jordan and a Jewish Home in Palestine all came as mandate from the league of Nations in 1920, the purpose of the mandate was to help these new national entities to developed and get on their feet and be able to manage themselves. The first point here is to refute the notions of colonialism in the middle east by the western powers. There were in total 14 countries during that same period that came into being under a mandate The only border that is still contested from that time is of the Jewish State. In the preamble of the Mandate For Palestine we read the following: Whereas the Principal Allied Powers have also agreed that the Mandatory should be responsible for putting into effect the declaration originally made on November 2nd, 1917, by the Government of His Britannic Majesty, and adopted by the said Powers, in favor of the establishment in Palestine of a national home for the Jewish people, it being clearly understood that nothing should be done which might prejudice the civil and religious rights of existing non-Jewish communities in Palestine, or the rights and political status enjoyed by Jews in any other country; and Whereas recognition has thereby been given to the historical connection of the Jewish people with Palestine and to the grounds for reconstituting their national home in that country In this preamble to the “Mandate for Palestine” the World community at the time represented by the League of Nations, and by that statement has recognised the ancient Jewish connection to Palestine. A national home for the Jewish people. In here the word “reconstituting” is crucial to the claim of Israel to the Land today. (any word of the Land being stolen here by the Jews?) Further down the preamble you have this statement: Whereas His Britannic Majesty has accepted the mandate in respect of Palestine and undertaken to exercise it on behalf of the League of Nations in conformity with the following provisions. Great Britain took its authority of the Mandate on behalf of the League of Nations. This was not another attempt at colonialism, by Great Britain. And the early leaders of Israel certainly were not carrying with them the British flag. The World through the League of Nations was making a commitment to the Jewish people to help them established a homeland for them in Palestine. ARTICLE 2. The Mandatory shall be responsible for placing the country under such political, administrative and economic conditions as will secure the establishment of the Jewish national home, as laid down in the preamble, and the development of self-governing institutions, and also for safeguarding the civil and religious rights of all the inhabitants of Palestine, irrespective of race and religion. It is clear from Article 2 the Mandatory (Great Britain) was to help established a Jewish National home while safeguarding the rights of other communities. (ie communities that are not Jewish) It does not claim that these communities would have the right to self-determination in that territory, it does say that the civil and religious rights of the other inhabitants of Palestine would be protected irrespective of race and religion. Article 5 “The Mandatory shall be responsible for seeing that no Palestine territory shall be ceded or leased to, or in any way placed under the control of the Government of any foreign Power.” Essentially the partition of Palestine in 1947 violates this article. The irony here is the very same people who recognised the authority of the League of nations to give them a country called Iraq, Syria and Lebanon, were the very same one that refuse to recognised the authority of this same League of Nations to established a Jewish homeland in Palestine. To top things up the Arabs even then refuse this partition of which they were not entitled to because they wanted the whole land of Palestine for themselves and none for the Jews. Article 6 “The Administration of Palestine, while ensuring that the rights and position of other sections of the population are not prejudiced, shall facilitate Jewish immigration under suitable conditions and shall encourage, in co-operation with the Jewish agency referred to in Article 4, close settlement by Jews on the land, including State lands and waste lands not required for public purposes.” And we know that during the British Mandate far from helping the acquisition of Palestinian citizenship for Jews, the British under pressure from the Arabs and seeking to appease them, did everything in their power to hinder the immigration of Jews to the Land. Article 7 “The Administration of Palestine shall be responsible for enacting a nationality law. There shall be included in this law provisions framed so as to facilitate the acquisition of Palestinian citizenship by Jews who take up their permanent residence in Palestine.” The Jewish authority of Palestine even then, and as early as 1922, would have been given the authority to issue their own passports and rights of citizenship. Article 15 “The Mandatory shall see that complete freedom of conscience and the free exercise of all forms of worship, subject only to the maintenance of public order and morals, are ensured to all. No discrimination of any kind shall be made between the inhabitants of Palestine on the ground of race, religion or language. No person shall be excluded from Palestine on the sole ground of his religious belief.” It is clear that the mandate was trying to established a society of equals where there would be a freedom of conscience and religion. Right from the start this was never an issue for Jewish authority. The moment the war began after the “illegal” partition of the land. (1947) All Jewish inhabitant in the “West Bank” had to flee they were immediately expelled. Wonder why this is not properly addressed? Jews began to return to their community after another war of aggressions against them in 1967 or the six day war. They did not conquered a new land, they were defending themselves what was there’s to begin with. In my view Israel should have annexed these territories immediately, offer citizenship to those inhabitants like the rest of Arabs communities that still reside in Israel and have full citizenship even today, and if they refused very well you are free to go, plenty of Arab countries all around. Article 25 “In the territories lying between the Jordan and the eastern boundary of Palestine as ultimately determined, the Mandatory shall be entitled, with the consent of the Council of the League of Nations, to postpone or withhold application of such provisions of this mandate as he may consider inapplicable to the existing local conditions, and to make such provision for the administration of the territories as he may consider suitable to those conditions, provided that no action shall be taken which is inconsistent with the provisions of Articles 15, 16 and 18.” It is from this article that the Mandatory (Great Britain) exercised its right to postpone or withhold provisions of the mandate. At that point Great Britain again I will say under pressure from the Arabs and wishing to appease them partition the land with the river Jordan as the boundary. East of the Jordan became the country of Jordan, which originally should have been given to the Jewish authorities. Was this not the original two state solutions? This happened in 1924, at that moment no more Jews was allowed into Jordan. Arabs however were still allowed to settle into Palestine. Perhaps one more point to make here, in the Charter of the United Nations, formed after WW2 in Paragraph 1 of clause 80 in chapter 12 protects existing acquired under international instruments such as the Mandate For Palestine In other words the United Nations accepted all the provisions of the Mandate For Palestine. But all that good will did not take long to melt under the hot sun of Judea… The UN refuses to uphold the law their own law of their charter. But just to make sure we nail that coffin shut if I may use the expression. Article 11 of the HAMAS Charter, state this “The legal status of Palestine according to Islamic law is like any other land that the Muslims have conquered by force, because the Muslims consecrated it at the time of conquest as religious endowment for all generations of Muslims until the Day of Resurrection.” By this admission they have declared that they are the one who have conducted a war of aggressions. Should aggressions be rewarded? Israel did not steel any land, they are the owner of that land not the occupiers! Shalom everyone!
