Gender Identity Service-Wide Guidance MOU On August 4, 2014, NTEU and the IRS executed an agreement regarding the implementation of the Gender Identity Service-Wide Guidance initiative. Pursuant to this agency initiative, the Office of Equity, Diversity, and Inclusion (EDI), Diversity Strategy Division developed a Gender Identity Guidance policy (draft attached). The policy includes terminology and definitions related to gender identity for those supervisors and employees unaware of gender identity issues employees may face. Furthermore, it includes processes for employees to utilize to ensure their personnel file accurately reflects their gender identity. The policy also includes guidance on restroom usage, dress and appearance, FMLA and sick leave issues, and privacy concerns. In addition, EDI created a Workplace Transition Guidance policy to establish a gender identity workplace transition and communication plan for management to create, in consultation with the employee, in the event an employee approaches management concerning her/his intent to change her/his gender identity (attached). EDI engaged in predecisional involvement regarding the two policies and incorporated NTEU’s comments. We applaud the IRS’s approach to this initiative. The policies are both progressive and thoughtful. In addition, the parties executed an agreement regarding the impact and implementation of the Gender Identity Service-Wide Guidance initiative. Some highlights of the MOU include: • The Agency will list the locations of all gender neutral restrooms service-wide on a link provided in the Gender Identity Service-Wide Guidance document on the Intranet. The list will be available for download and printable from the link. • The Agency will provide National NTEU with the training materials that will be utilized for this initiative. These training materials will be an important tool for all NTEU chapters. The NTEU bargaining team consisted of Chapter Presidents Samantha Barnes (Chapter 72) and Jacqueline Huff (Chapter 73), Heather Phillips (Chapter 73), and Assistant Counsel, Gretchen Paulig, Austin Field Office.
