If I read the article and believed what it said as fact it could be strongly argued that as a member of the general public I would be mislead into thinking that the BCTF has not done its due diligence in communicating to the government the challenges that it has with clause E80 and the government is therefore confused about what these challenges are. This however is simply not true. The BCTF has done its due diligence in communicating to the government the challenges that it has with clause E80 in that it would put language into the contract giving the province an escape clause for any future class size and composition court decision and the government is aware of this.
