Good morning Tybee Island! Let’s talk about variances. I’ve been appointed by Tybee Island City Council to two terms on the city’s Planning Commission. One of the touchiest subjects that comes before the Planning Commission is requests for variances to the Land Development Code (LDC). The Planning Commission is not the decider on these variance issues, but City Council wants us to make a good recommendation to them so they can decide. Some of these are tough calls, but the LDC is clear about what constitutes a valid request. It states that a variance may be granted in the case of a hardship and then goes on to define what constitutes a hardship. Each request must be judged on its own merits, and any request that gets approved should meet the variance criteria. There are exceptions to every rule and the words written in the LDC cannot possibly anticipate every circumstance that might arise, so I will always listen to the requestor and cast my vote for or against based on the facts.
