Governor Snyder signed House Bill 4118 A new law permits the Department of Human Services to order drug testing of those receiving benefits through The Family Independence Agency suspected of illegal drug use. For those who test positive, one may lose state benefits. This is only a pilot program. DHS will select at least 3 counties to test this program by October 2015. So far, it appears that the use of such records will remain confidential and not necessarily be used for criminal prosecution. So far... It is important to recognize that the U.S. and a Michigan constitutions require warrants based on probable cause and mere suspicion to permit such invasions into privacy. This will give DHS, an already very powerful agency, more power to insert itself into ones life. This will likely be a significant source of debate.
