Govt lying in Hari Shankar Pandey enquiry case (Brief Note of the Press Conference by me at my residence)-- The State Government has said that the enquiry report of PCS officer Hari Shankar Pandey in Rural Engineering Department scam and Director Uma Shankar age reduction are completely incorrect and beyond reality. I present the real facts and the Government claims in this regards- 1. Govt claim-- Pandey used the word CAG report while this is not CAG but it is report of Accountant General, UP, Allahabad TRUTH-- As can be seen from the first page of the report, this is the report of the भारत के नियंत्रक महालेखाकार परीक्षक which in English is Comptroller and Auditor General, CAG. CAG has its branches in each State and in UP, its office is there in Allahabad. Hence, this is nothing but CAG report. 2. Govt Claim-- This report or the 21 December 2012 minutes of meeting chaired by Accountant General does not use the word “scam” TRUTH- CAG report does not use the word “scam”. It only consists of the facts that come after the Audit report. It is only on these facts that many scams later come to fore. Hence to say that just because the word “scam” has not been used, hence it is not a scam is completely incorrect. Even otherwise this CAG report has used the words against orders, failure to comply Government of India’s instructions, violation of financial powers, predated technical sanction, irregular award, fake security deposits, inadmissible FDRs, arbitrary relaxations in terms and conditions, irregular expensxes etc ion many occasions. All these words are synonym with cam. CAG also made physical verification at many places and has also presented many photographs that show that there were lots of irregularities. Hence this is nothing but a scam. 3. Govt Claim-- The Draft Report is not Final as yet TRUTH- While it is true that it is only a draft report but the fact is that it carries a large number of irregularities. Why is no action being taken on this report itself? Why is it being ignored? 4. Govt Claim- Copies were given to Chief Secretary etc against Government administrative rules TRUTH- This is the internal matter of administration but the fact remains that if an officer directly gives copies to senior officers where he presents important facts as regards a serious scam, what is wrong in that? On the contrary this officer should have been appreciated for his serious and sincere work in unraveling a scam and not be punished only for this. 5. Govt Claim- Director RED Uma Shankar’s age had always been 25/10/1957 है, it has not been changed TRUTH --This is completely false statement. The fact is that Uma Shankar’s age was changed from 25/10/1951 to 25/10/1957 through a GO dated 16 June 2009 signed by Harendra Veer Singh, Special Secretary, RED, thus reducing age by 6 years. This is completely against the UP Enrolment in Service (Fixation of Date of Birth) Rules 1974 passed on 28 May 1974. Its Rule 2 says-“ The Date of Birth of any government servant shall be the one that has been stated as his Date of Birth in his High School or equivalent examination and no representation of any kind shall be entertained in any case as regards correction of this Date of Birth.” Despite these clear Rules, the DOB of Uma Shankar was changed after wrongly accepting his representation while his DOB was 25/10/1957 in both the Final Seniority list prepared on 04/01/1995 and again on 14/12/2001 and he had not objected to this once. It is also important to note that the original service book of Uma Shankar is lost. Hence changing the DOB after so many years of service against the Rules is clearly illegal , which was unearthed by Hari Shankar Pandey END NOTE-- I have presented an application for registration of FIR before District Judge where the final order is expected. Similarly my application about age reduction has been entertained by CJM Lucknow as complaint case and it is pending before the CJM.
