Grandparents Rights to Visitation: There is a two pronged inquiry that must be satisfied in the petition and at the time of a hearing on the issue of Grandparents Visitation: 1) the grandparents must have standing to bring this action before the Court and 2) what is the best interest of the children. As for the first prong of the inquiry, generally the Court will require a showing that the grandparents were actively involved in the grandchildrens life and for some reason the relationship was interrupted. Generally this break occurs upon the death of the grandparents child, the parent of the child. We have had hearings where the relationship terminated because of an argument between parent and child. The Courts are inclined to grant and foster grandparent visitation provided that it is in the best interest of the grandchildren. The practical and most economic approach is to attempt a reconciliation. Make up with you kid. Use the Court only as a last resort. The lawyer needs to know the background information regarding the nature of the family relationship. This information will be necessary in accessing you case and if necessary, drafting a petition If you have no way of contacting your child, then commencing an action to establish Grandparents Rights of Visitation may be your only recourse.
