Group input needed: Please post anonymously: I would appreciate insight and advice regarding the “discovery” phase of a divorce with a sociopath. Despite the fact that I live in a no fault divorce state, the ex has managed to legally refute all my attempts to divorce him. This is expensive. I have blown through the savings I set aside to leave him after the years of abuse. I only work part time at this point (I have been financially dependent on him for 13 years while I have been the main caregiver of our two children). He has wealthy parents who bankroll him off the record. This is necessary because he resigned from his full time, white-collar job three weeks after I served him with papers. He now works part time doing menial work on a shift that would allow him to take custody from me if I were to get a full time job. One of my children was suicidal after the split…this particular child disclosed to the therapist that in order to stay safe the dad needs to be out of the environment. You can imagine my mama bear instincts in terms of making sure I remain the residential custody parent. Back to the “discovery:” in an attempt to move forward with the divorce, since September, my attorney has been requesting paycheck stubs and the required divorce affidavit-where the ex has to disclose assets (including 401ks with substantial sums that I do not have records of..). The ex ignores all requests. It seems a game for him. He knows I do not have financial resources to match his parents’ and I suspect he thinks I will just give up and take him back. Practically speaking, this means I have no child support. It also means we have no permanent custody set up. I have no health insurance. It also means I have more contact with him—I would like none. So, we move to the discovery phase. My specific questions: what can I expect in this process? How expensive will it be? What comes next? How can I prepare myself? How can I best protect myself? Is there anything I need to do? I would appreciate any useful information including resources to support me in the process. Thank you!
