Dallas attorney Robert Guest, head of the criminal division at Guest and Gray PC, doesn’t see Mobley’s lawyers mounting such a defense.“The castle doctrine will not help Mobley, but he should have other defenses available,” Guest said. “The castle doctrine does not apply to defending another person’s car against a public auto theft. Texas does have protections for the use of force to protect the property of another, and citizens even have some arrest power in Texas.”
