HC gives relief to MRF trade union HYDERABAD: Justice Ramesh Ranganathan of the AP high court on Friday termed the action of the labour department officers in cancelling the registration of a trade union working in MRF factory near Hyderabad as a violation of the fundamental right to form trade unions. Allowing a writ petition filed by MRF Mazdoor Sangh, which is affiliated to the Bharatiya Mazdoor Sangh (BMS), the judge said the managements do not have the guaranteed right to participate in the issue of registration of trade unions. The petitioner union, through its president Mallesham, had complained to the court that after the union was registered, the management filed a complaint with the labour department and the officials conducted an inquiry behind their back in the factory premises. The union averred that all this was at the behest of the management and the cancellation based upon such a sham inquiry was unconstitutional. The judge called for the records and said that the fundamental right to form a trade union cannot be taken away so easily. He found fault with the labour department for conducting such an inquiry and critiqued each phase of the inquiry and each finding by the joint and deputy commissioners of labour. The officers failed to see that the strength of the membership has increased after the registration. The court wondered how the management could come into the picture at this stage regarding the registration. The court set aside the cancellation of registration and directed the officers to strictly follow the provisions of the Indian Trade Union Act. HC stays excavation in Khammam sand reach Justice Ramesh Ranganathan of the AP high court directed the Khammam district collector and other officers of the district to ensure that no sand is excavated or transported from Patha Gommuru sand reach in Nagineniprolu tribal gram panchayat, Brugumpahad village, Khammam. The judge passed these orders in a writ petition field by Banot Hamu, a tribal who complained that unauthorized persons were running the quarry in the name of a tribal co-operative society in the scheduled tribal area. These persons have not paid money to the tribals who worked as labourers, he alleged and also complained that the excavated sand had disappeared, a claim confirmed by the officers. He also complained that nearly Rs 1 crore had been siphoned off and the officers were clandestinely permitting the transportation of sand. The judge ordered issuance of notices, stayed the excavation and transport of sand, and called for the records.
