HC grants Haryana govt a chance to review its decision in a week . Haryana government has been granted an opportunity by the Punjab and Haryana high court to reconsider its decision under challenge regarding allotment of plots to 79 legislators in Panchkula in 2008 on the pretext that during state assembly sessions accommodating legislators is a problem. Advertisement Whereas state government records reveal that there is enough accommodation for housing its 90 MLAs and 10 MPs in Chandigarh and Panchkula at the same time. Is there any inclination in the state secretariat to reconsider whole thing since you have not practically handed over the plots? the division bench comprising justices Surya Kant and Amol Rattan Singh questioned the state counsel. To this the counsel pleaded for some time to seek instructions from the authority. Justice Surya Kant said, Administrative decision can be reviewed if they think it is wrong. Now-a-days everyone is in action mode. If they want they can decide everything, adding that it was not mandatory that every decision should go through judicial review. Senior advocate ML Sareen, appearing for one of the parties, said that there was less likelihood of reviewing the decision as the same political party was in power. Comparing this allotment with other reserved categories, the court said, Housing policy for defence personnel working on borders in tough conditions is a social security to their families but the same thing may not be applicable to elite class people. Noticing enough government accommodation in Chandigarh and Panchkula, the court remarked, It is a good initiative by state to have such an infrastructure in its various co-operations and boards. The case Legislators were allotted one 14-marla plot each by the Haryana Urban Development Authority (HUDA) in Sector 6, Mansa Devi Complex, Panchkula, at throwaway prices in 2008 which was challenged by The Herald Cooperative Group Housing Society, Panchkula. Beneficiaries include Deepender Singh Hooda, Naveen Jindal, Kiran Choudhary, Randeep Singh Surjewala, Chander Mohan and Karan Singh Dalal.
