BOX 365 LESSOSS 0717-795 367 24th November, 2014 THE KASS MEDIA [email protected] [email protected] In 1987, Mr. Andrea Rono approached my family with a proposal that he had been requested by Jepkoech Japkili Meto to look for a girl to marry. After discussion with my family I was allowed by my father to accompany Andrea to Kapnyeberai home of Jepkoech Tapkili where we discussed about her proposal. Andrea Rono, Jepkoech Tapkili and myself discussed the proposal further and after that they asked me to stay with Jepkoech Tapkiti Meto till august 24, 1987 from February, 1987. the late Mrs. Sarah Meto the co-wife of Jepkoech together with elders from Kepsoen village and relatives went for an engagement at our family home at Ngeria where an engagement ceremony was witnessed by both parties in the presence of my late mother, father and the other party led by the late Kibirgen Arap Kogo and the co-wife of Jepkoech the late Sarah Meto. After agreement during the engagement ceremony and witnessing the ceremony in writing and bargaining the dowry, Jepkoech Meto requested my family to grant me permission to return with them to Kapnyeberai Kapsoen because she said there was no other person to look after cows and other domestic chores and my father allowed me to return with them as we came. When I went there in February 1987 I discovered that both Jepkoech Meto and her co-wife Sarah Meto were not blessed with children except that Tapkili gave birth to a female child who died when she was delivering a child in 1984 and after the demise of her only child she also became childless like her co-wife who never got a child but managed to marry two wives whose children live on her shamba. one of Sarah’s wives pass away in 1980’s and we live with her co-wife one the same land which previously belonged to the husband of Sarah and Jepkoech Tapkili the late Mr. Kimisoi Arap Meto who passed away in 1970 and his two wives Sarah and Tapkili succeeded his property by sharing equally in 1970’s. This is the report which I learnt during my 6 months stay with my woman husband who married me according to Nandi customary laws of woman to woman marriage which is intended to light the fire of such families bedeviled by misfortunes of failing to sire children or those who give birth to females only. After engagement and marriage ceremonies in 1987, my father came to take (Kanyiok) dowry and therefore I am the legal wife of the late Jepkoech Tapkili who paid dowry and was responsible for the welfare of our children from 1987 till march 2005 when a conspiracy were hatched by fraudsters who concocted falsehoods and went to high county at Eldoret to sue me taking the advantage of the age of my husband after she visited them towards the end of 2004. I have lived on her shamba from 1987 to date. Jepkoech Tapkili Meto my husband has been taking care of her children by giving family names to them, naming them after the spirits of Kaborok clan and during circumcision of the boys naming them after the ancestors of the family and presiding over as head of the family alongside family elders and during the engagement of her daughters by her permission as head of the family. She identified the burial sites of her two daughters Stella Cherotich 1991 and Jebichii in 2002 and George Kibet in 2004. Who were all buried on Plot No. Nandi/ Kilibwoni 1023. She is also the one who paid the medical expenses of the three children incurred at Moi teaching and Referral in 2002 and 1991 at Kapsabet nursing home and various government clinics. Her 3 sons namely Sammy Kiplagat Meto, Phineas Kipleting Misoi and Simion cheruiyot Misoi are all married and live on 1023 at kapsoen since 1987. Her three daughters have been married off over 10 years ago. All the children of Tapkili Meto are living on the farm apart from those who were married off. Other children of the late Tapkili Meto who live on the same plot 1023 are all together six apart from those who have their families. In January 2005 a few months after she visited her brother Malakwen Choge I was informed that my husband Tapkili Meto was sick and I went to see her and she told me that after recovery from sickness she was intending to return home and the children also used to go and see her when Kogo Japkili was sick. In 2005 Tapkili Meto sued me at the high court at Eldoret claiming that she has withdrawn my contract as a licensee and sometimes as a maid, a house help or a worker while in actual fact I am the legal wife of Tepkoech Tapkili Meto married under Nandi customary law and witnessed in writing by many people in august 29, 1987. The case has proceeded from March 2005 to 30 November, 2014 when judgment was delivered in favour of my husband and after being denied engagement and marriage crucial witnesses from Ngeria and Kepsoen areas. • Strange ruling were given to defeat justice especially one which was delivered on 30/11/2009 RE: ELD.HC.CC NO 25 OF 2005. • Transfer of title no Nandi/ Kilibwoni 1023 in a fraudulent manner to one Johana K. Too while the case was still pending at high court at Eldoret. • Blockade of my witnesses including my father, Andrea Arap Rono, Raphael Chopkwony and others under the influence of Wafula & Co. Advocate who was representing Jepkoech Meto my husband. • Withdrawal of my first advocate Mr. Ngigi Mbugua without notice. • Coincidence of the death of my woman husband immediately after the period of judgment in August 2014. • Invalid court order issued at Kapsabet to stop the burial if my husband on an illegal land at his brother’s home while she owns land Nandi/ Kilibwoni 1023. • Burial at night contrary to Nandi culture and custom and the laws of Kenya. • Burial of Kogo Meto in the absence of a Catholic priest because she was a Catholic faithful and the burial ceremony at night presided by a member of AIC. • Having lived as wife with children from 1987 to 30th June, 2014 on plot no Nandi/ Kilibwoni 1023 a total of 27 years and justice Silas Munyao found it wise, human, constitutional, Christian, customary and cultural to legalize disinheritance of the rightful children of the late Jepkoech Tapkeli Meto and condemn the 12 living children and the 3 dead ones to the streets because of unknown considerations. • I am the legal wife of Jepkoech Tapkili and I am appealing to all institutions and organization in the Republic of Kenya including President Uhuru Muigai Kenyatta, Kenya Human Right Commission, chief justice of Kenya Hon. Mutunga, Chief Legal Adviser Githu Muigai, Minister of Lands Charity Ngilu and all Women in Kenya. I have appealed against the whole judgment delivered on June 30, 2014 and I am unable to raise appeal court fees and charges and this is the reason why I am humbly appealing for assistance from this nation of Kenya.
