HELP! I have been threatened with a $10,000 fine in 2 weeks time if i do not remove all records of my 8 years of study and 23 years working and serving the public as a registered Doctor of Chiropractor from the world wide web ... with no prior correspondence at all! Sent by an EMAIL from NZ Health Dept and NZ Chiro Board! Where do they find their lawyers? How professional or safe are these people? Can we get some media coverage on this? Can my legal identity be removed from me in 2 weeks by a Chiropractic Board in NZ? Its time to speak out against abusers in positions of power. Heres my reply ...7 August 2014 New Zealand Chiropractic Board Level 3 Freemason House 195-201 Willis St WELLINGTON 6011 Dear Phil Knipe, I felt sad when I received your letter as I am in my 60th year, and close to retirement, and not looking to cause harm to anyone, including myself. I am shocked and surprised at your threat (via an email) to remove my Doctorate and legal identity of over 20 years of study and work and service to the public, as well as impose a $10,000 fine, with no prior correspondence. You have stated in your letter that (Section 7(1), Health Practitioners Competence Assurance Act 2003): Unqualified person must not claim to be health practitioner (1)A person may only use names, words, titles, initials, abbreviations, or descriptions stating or implying that the person is a health practitioner of a particular kind if the person is registered, and is qualified to be registered, as a health practitioner of that kind. You have also stated: The ministrys approach in enforcing the act is first to seek compliance. In cases where persons are unwilling to comply with the Act, the ministry may seek to prosecute. Prosecutions under section 7 carry a fine of up to $10,000! I think it prudent that the Ministry would first seek compliance. However, I am surprised that I would be expected to do this within 2 weeks via email correspondence. I do not believe I am in contravention of Section 7(1) for the following reasons: I am not claiming to be a chiropractor in New Zealand. As I will outline below, I am using my chiropractic credentials because they have been part of my identity for 23 years, all of my documents contain the credential Dr., and because it provides credibility to my business, which is not chiropractic but is Divine Clearing. My new method called Divine Clearing was created during my 20 years working as a Doctor of Chiropractic (in the U.S., Ireland and India), but in and of itself it is not chiropractic. I am and have been a registered, licensed Doctor of Chiropractic in the USA for the past 23 years. In fact, I just paid the $600 renewal fee. For your information most of my services are by Skype to repeat clients overseas, (mainly USA, Europe and India) and this is the bulk of my income. My last 14 winters were spent in India, giving service to poor village families, and I give continuing Skype sessions to them. My work in NZ is mainly Skype (Divine Clearing – not chiropractic work) and some Animal Communication work with horses. I do not have a chiropractic office or any chiropractic equipment whatsoever. However, per your letter, I have gone through my blog and removed anything that may suggest I am currently doing chiropractic work. I have outgrown that modality many years ago, as for me the chiropractic approach is too narrow. I do need to keep my title as Dr of Chiropractic (U.S.) however for the reasons above and so my international business can flourish. My legal advisors, work associates, mentors, investors, family and community in USA, India, New Zealand and Ireland have all recommended this. I have an appointment with a lawyer in Auckland CBD later today to clarify my legal rights in NZ, and to record my concerns about loss of income. I feel a loss of income may result from not being seen as a person with a lifetime of service to others. Loss of income would result in my not being able to be benevolent to others in need around me, which is my primary vision in life.
