HIGH COURT STRIKES A FATAL BLOW TO LAND GRABBING IN MERU COUNTY The High Court in Meru has dealt a fatal blow to the forces of impunity in the Provincial Administration and The Local Authority in a landmark ruling delivered on 2nd August 2013. This was in a case filed by the local residents and natives of Tigania East and West Constituencies involving the attempts by the Clerk of the defunct County Council of Nyambene and the immediate former District Commissioner, Tigania East District Mr. Meru Mwangi trying to prevent them from carrying their usual farming activities on their ancestral land that borders Isiolo County stretching from the airport all the way to the border of 78 Tank Battalion. It was the contention of the clerk and the DC that this land belongs to the Local Authority and therefore the natives had to vacate and let the clerk do as he wished. This position was vehemently opposed by the natives who felt that the clerk was acting in cahoots with the current chief of Ngaremara, a retired sub chief and a host of other people who were out to dispossess them of their land. The natives who were represented by lawyers Gitobu Imanyara, Rodgers Karumpu and Mercy Kaume had been accused of contempt of court in that they were alleged to have destroyed the survey beacons that had been placed on their farms by a private surveyor hired by the defunct council and paid using the CDF money from Tigania East constituency. The High Court at Meru in Miscellaneous Civil Case Number 100 of 2010 dismissed these allegations and condemned the Clerk and the DC to pay the costs of that process. It is now back to the drawing board to the forces of impunity and land grabbers since the court has killed their ambitious plans to take advantage over hapless natives and peasants
