HS2 CPO clause fears Legal experts have raised concerns over a compulsory purchase order clause in the HS2 hybrid bill, published just before Christmas. Lawyers representing landowners and local authorities describe the wording of the clause as unprecedented. “This clause, which has no spatial or time limits, represents a new general power that is unprecedented in the history of infrastructure projects,” said Robbie Owen at Pinsent Masons. Mr Owen warned it could lead to “a considerable unintended blighting effect,” a notion rejected by an HS2 spokesman. Angus Walker, a hybrid bill specialist at Bircham Dyson Bell, said that, while the clause may not lead to blight as defined in law, “it may worry people into thinking that their land might be acquired and therefore the value of it may go down”, while Alistair Lewis at Sharpe Pritchard, said he expected local authorities would seek to challenge the clause as it “seems to be usurping” their own compulsory purchase powers.
