The family met with investigating officer on Friday, January 24, at their home. I only went to court once and on that day the case was remanded. I never heard from the investigating office thereafter. I was not called to court when the decision was made to throw the case out, said angry mother Dilshaad, glancing at her son lying helplessly on the bed. The investigating officer working on the case informed the family that the case had been thrown out of court due to insufficient evidence that could hold the driver responsible for the accident. The investigating officer told us that in his reports it is Luqman, who was at fault for the accident, said Luqman’s father Akbar. How can the blame be put on a child, a child that is 6 years-old, added Dilshaad Luqman and his older brother Shanawaaz (8) were on their way home after visiting their cousins when the accident took place. Witnesses on scene at the time said the vehicle was allegedly speeding before hitting Luqman. Paramedics on scene managed to revive Luqman before takin him to hospital. Luqman spent 28 days in a comma and on 29th day the doctors at Baragwanath Hospital managed to pull him out of his coma. He suffered traumatic brain injury and as a result he cannot move his body or speak like an ordinary 6-year-old child. Parents at the time were relieved as their little boy was at least awake. This, however, has not restored their broken hearts because despite him being out of a coma and now at home things have become increasingly difficult for the parents to take care of this child who requires a lot of special care. Luqman has been given back to us but his life is not the same anymore, said his mother. A peg was inserted through his stomach so that he is able to eat but still does not move his body or speak. It has been ten months of torment and agony for the family to see him in this state. Look at Luqman now, he was a normal walking and talking child, now he can he can’t even eat or move on his own. It painful for us to see our child like this, said a tearful Dilshaad. The family explained that they are doing their best to get him back to experiencing the life he had before by taking him to the mosque on Fridays, and to the park, as well as the movies occasionally, but it still remains a difficult task. The justice system has failed us but we refuse to give up, we will do everything to ensure that justice is served, not only for Luqman, but for every other child who has been through this, she added. The family thanked the Baragwanath Hopital’s Ward 32 for their assistance as well as the community at large for all their contributions. Luqman will be undergoing treatment at a rehab centre for nine months. If anyone would like to assist the family in anyway contact Dilshaad Khan on 011 854 4900 or 0723922818
