Take a look at page 18 erc.or.th/ERCWeb2/Upload/Document/CommentariesOfLawRelatedToEnergyIndustry.pdf Royal Decree Be it, therefore, enacted by the King, the Royal Decree, as follows: Section 1: This Royal Decree is called the “Royal Decree on the Determination of Categories, Capacities and Characteristics of Energy Industry Exempt from License Requirement B.E. 2552”. Section 2: This Act shall come into force as from the day following the date of its publication in the Government Gazette. Section 3: Categories, capacities and characteristics of Energy Industry exempt from License requirements are as follows: (1) Electricity Generation business with a total capacity of each business being less than 1,000 kW ampere (2) Electricity Distribution business of which the electricity generator in (1) uses the generated electricity for their own business. (3) Electricity Distribution business with total distribution capacity less than 1000 kW ampere supplied through Power Distribution System. (4) System Operator whom generally has no direct responsibility in dispatching generation. (5) Natural Gas Storage and Transformation of Liquid to Gas business of which the total storage of liquefied natural gas of each storage facility is lower than 50,000 liters. Section 4: The Minister of Energy shall have charge and control of the execution of this Royal Decree. Countersigned by Abhisit Vejjajiva Prime Minister Please also remember this is an act which an act is not law unless you agree with the act. Then it becomes a contract under law.
