The Honourable Deputy Judge President Traverso J Judges Chambers High Court of SA :Western Cape Division Cape Town 30 November 2014 Dear Judge Traverso Re : Extradition guarantee to a trial without fear favour or prejudice : Dewani case It is with regret that I am obliged to bring to your attention alleged irregularities associated with the defendants attorneys in this case, Edward Nathan Sonnenburgs (ENS), that might well demand their recusal in this trial These alleged irregularities to include alleged association of the undermining of the Judicial authority of SA courts through the practices of the forging high court orders, and the creation of court judgments from outside the authority of the case relevant presiding judge, for submittance as court rulings purporting to be by the judges hand. That these practices allegedly exist at all is of concern, especially in the case referred to above over which you preside, as whilst the SA constitution grants all SA citizens a derogable right to a fair trial, in the case before you this right is guaranteed by the SA government to HMG, in accordance with the extradition treaty relating hereto. Whilst this communication in no way infers that this alleged abuse of the Judicial authority would apply to your honorable court, or the defendants excellent Counsel. I respectfully submit that the existence of these alleged practices relating to the defendants attorneys ENS, demands that it be brought to your attention. The reason why these concerns were brought to my attention arose is as a result of my visit to SA last year where I made submissions to the Ministerial parliamentary committee for the Legal Practice Bill(LPB), and to the Chief Justice entitled CASISA The purpose thereof was to propose the implementation of structures to hold legal professionals accountable to their oath of office, which our experience confirmed do not exist, given that existing structures are not guaranteed to be enforceable as concurred with by my ex attorney William Booth, and the need for the LPB, in our alleged Lloyds UK insurance fraud ten year investigation relating to phone hacking. During the course of my visit to SA I was asked to assist in the investigation of the existence of forged high court orders by the Deputy Commissioner of SAPS(KZN), which included our offering an advertised R 1 million reward One of the profound implications of the conduct referred to in paragraph 2 above, being allowed to live in the SA Justice system is, as per the current case before your court, is that by default, no matter what decision your honourable court might reach in this matter, the guarantee referred to above, could be affected thereby. As it is true that it is unconscionable that either your court or the excellent Counsel for the defense, would ever be associated with this conduct, and that in the normal course of events this conduct could be referred to a relevant authority to address, I respectfully submit that in the case before you no such structure exists that will timeously ensure the integrity of the guarantee referred to above, if, as I am advised, your court is to make a decision relating to the case before you by December 8th. As is the case with captain of industry Mr Johan Rupert who, as per your court, is by default affected by association with the attorneys related to this latest alleged unlawful conduct, as recently brought to my attention, as he was in this particular instance of investigation, the beneficiary thereof. As is the Hindocha family. I have requested a meeting with Mr Rupert to assist us in considering a timeous solution that will ensure the protection of the guarantee of your honourable court’s ruling in the case before you; Given that this alleged conduct is also related to the promotion of child slavery, and the delictual practice of interfering in the sale of SA famers land at 50% of its value, which has implications for the SA political economy. Any assistance in ensuring a swift addressing of a resolution to the concerns referred to above by supporting our request for the proposed a meeting, to ensure the same, would be most gratefully appreciated.
