Dear Sirs Formula One World Championship Limited (FOWC) has the exclusive right to commercially exploit the FIA Formula One World Championship (the Championship) including, but not limited to, all moving images, other audio/video content, timing data and results. In addition, FOWCs associated company Formula One Licensing BV (FOL) is the owner of numerous trade marks throughout the world relating to the Championship, including F1, FORMULA 1, FORMULA ONE and all official logos (“Formula One Marks”). The copyright subsisting in official logos is also proprietary to FOL. We have noticed from your App https://play.google/store/apps/details?id=com.andromo.dev46738.app148830 that you are utilising one or more Formula One Marks as or as part of the name of your App. As you have neither sought nor obtained a licence or permission from FOWC to use its Formula One Marks in this way, we will need to ask that you immediately cease all use of such marks and confirm to us via email that you have done so. If you have not complied with this request within 14 days of receipt of this notice, i.e. by the 25th of November 2013, we will be forced to issue a takedown request with Google. Should you wish to use Formula One Marks editorially to report on or provide information concerning FORMULA 1 events, you may do so, provided that such use does not create any unauthorised association with the Formula One group and/or the Championship and you follow all requirements of the Formula One group’s Editorial Guidelines, the current version of which is available at formula1/trademarkguidelines.html. This includes displaying the following disclaimer whenever you refer to the Formula One group, the Championship and/or FORMULA 1 racing in general: “This App is unofficial and is not associated in any way with the Formula One group of companies. F1, FORMULA ONE, FORMULA 1, FIA FORMULA ONE WORLD CHAMPIONSHIP, GRAND PRIX, FORMULA ONE PADDOCK CLUB, PADDOCK CLUB and related marks are trade marks of Formula One Licensing B.V.” We would clarify that this does not apply to official logos, which cannot be used without express authorisation from FOWC. Nothing in this letter is intended or shall be construed to constitute an express or implied waiver of any of FOLs or FOWCs rights or remedies, including any rights or remedies in respect of infringement not explicitly stated, whether current or in the future, all of which are expressly reserved. Formal Declaration I hereby state that FOWC and FOL are the owners of the exclusive rights referenced above and that NetResult is authorised to act on their behalf with respect to internet monitoring and compliance.
