Heres an interesting read. This is part of the FIRST motion to dismiss the case against Judge K. This is part of the politics of this case. A. Background Politics In April 2013, Judge Byron J. Konschuh was appointed to the Lapeer County Circuit Court by Governor Snyder over Timothy Turkelson. Before Konschuh’s appointment to the bench, Judge Konschuh was the prosecutor for Lapeer County. His appointment to the bench created a vacancy in the Lapeer County Prosecutor’s Office. In May of 2013, over the objections of Judge Konschuh, Chief Judge Nick O. Holowka appointed Konshuh’s nemesis, Timothy Turkelson as Lapeer County Prosecutor. Beginning in November 2013, Timothy Turkelson, as the new Lapeer County Prosecutor fired all Konschuh’s assistant prosecutors, (with exception of Cailin Wilson who is on board to testify against Konschuh), and then spent eight (8) months investigating Judge Konschuh’s use of the $5.00 stipends that Konschuh obtained through the “bad check” recovery program and used to pay for unfunded office-related expenses. In an attempt to avoid appearing as the political opportunist, Turkelson with the advice of Judge Holowka, did not charge Konschuh with a criminal offense; instead, he contacted the Michigan Attorney General’s Office for the appointment of a special prosecutor to do his dirty work. Larry Burdick, Assistant Executive Director of the Prosecuting Attorneys Coordinating Council was assigned by the Attorney General’s Office to appoint a neutral prosecutor. When Prosecutor Finnegan was asked to take the case, she responded in an email to Burdick, expressed her zealousness stating that she would be “thrilled to take the case … I have never lost a case with State Police Investigator Pendegraff”, (exhibit #5). Burdick, responded at least three (3x), “there may very well be a valid explanation”, (exhibit #5 or #6). but Finnegan wasn’t looking for an explanation; instead, she was looking for political splash to help her own campaign for Circuit Court vacancy in Shiawasse County. So, in July 2014, Finnigan, based on Turkelson’s allegations, and her own self-serving interest, charged Konschuh claiming the use of the funds for the benefit of the prosecutor’s office was illegal. She charged Konschuh with five counts of embezzlement by a public official over $50.00, MCL 750.175. Judge Konschuh believes that the charges are politically motivated and that he will be absolved of any wrongdoing once a court reviews the applicable law.
