Hey facebook! I need some help for one of my assignments and was wondering if anyone would pitch in. Should go pretty quick and I need 3 people to help out. First, I am to offer you an overview of inmates rights. So really quickly, The First Amendment: Congress shall make no law respecting an establishment of religion, or prohibiting the free exercise thereof; or abridging the freedom of speech, or of the press; or the right of the people peaceably to assemble, and to petition the government for a redress of grievances. Some loopholes of the first amendment in prisons: Censorship of mail is permitted. Inmates do not have a right to receive mail from one another. The Muslim faith must be recognized as a religion, and officials may not restrict members from holding services. The First Amendment does not protect sham religions So basically, Speech and Religion are covered extended to inmates. The Fourth Amendment: The right of the people to be secure in their persons, houses, papers, and effects, against unreasonable searches and seizures, shall not be violated, and no warrants shall issue but upon probable cause, supported by oath or affirmation, and particularly describing the place to be searched, and the persons or things to be seized. Some loopholes of the fourth amendment in prisons: Conversations recorded in jail vistitors room are not protected by the Fourth Amendment. A warrantless search of a cell is not unreasonable strip searches including body cavity searches is not unreasonable. The Eight Amendment: Excessive bail shall not be required, nor excessive fines imposed, nor cruel and unusual punishments inflicted. Some loopholes of the Eight Amendment: Double celling and crowding does not constitute cruel and unusual punishment. An innocent prisoner mistakenly shot in the leg during a disturbance is not protected under cruel and unusual punishment. Suspending visiting privileges for two years because an inmate flunked two drug tests does not constitute cruel and unusual punishment. The 14th Amendment: Rights to Due Process Some loopholes of the 14th Amendment: An inmate has no right to counsel in a disciplinary hearing. Prison regulations do not violate due process unless they place atypical and significant hardships on a prisoner. Questions to answer (please and thank you) a) Are you surprised regarding any of the rights currently afforded inmates? Which ones? b) Do you feel that inmates have too many rights? Are there any that should be taken away? c) Should the courts re-assume a hands-off policy in regards to inmates, and leave the business of corrections in the hands of corrections?
