Hi All: Time for an update after receiving so many messages and support so here goes: What am I trying to achieve? The bottom line some clear legislation to bring an industry that is clearly off the tracks in line with what is decent. Regarding Talbot Green Car Park, increase the free time from 30 minutes to an hour, At present this is how New Generation Parking Management are making their money. If you go to the bank or where ever and have to queue or get delayed they try and get £100.00 from you. I believe they don’t get paid to manage the car park by the land owner; they depend on threatening and charging the venerable. Make them follow the rules and put the signage right, the entrance sign fails to follow the BPA Code of Practise: britishparking.co.uk/write/Documents/AOS/AOS_Code_of_Practice_-_V4,_Feb_2014.pdf 18.2 of the code states: The size of the sign must take into account the expected speed of vehicles approaching the car park. Try reading the small print when you’re driving over the pavement to enter the car park. 16,5 of the code deals with disabled drivers, it says: If your landowner provides a concession that allows parking for disabled people, if a vehicle displays a valid Blue Badge you must not issue it with parking charge notices. The land owner provides a concessionary disabled parking space but the entrance sign states “This includes Blue badge Holders” this is against the BPA CoP. Remember these words “You must not issue it with parking charge notices” Now see how many have been charged when showing a Blue Badge I’ll start it of with the case I won when NGPM failed to justify the charge by not presenting POPLA with any evidence. More on Signs: The Car Park is split into two sections: Permit Holders and Free parking yet all the signs are in the permit holders section. With the entrance sign failing the code and the signs on sit set out as they are it’s clearly an effort to deceive the motorist. I will go on later but I would like to leave you with this thought: In a Freedom of Information Request to the DVLA for a copy of the last audit the DVLA did on NGPM (If you need a copy please ask) it states: Land Owner Agreements You provided an example of a current landowner agreement and I noted that it did not meet the requirements of clause 7.2 (f) of the BPA’s Approved Operator Scheme (AOS) Code of Conduct in confirming that the landowner authorises New Generation Parking Limited to take legal action to recover a parking charge. Although you then provided a copy of your current template, where the necessary wording is included, we discussed the need for this to be present on all of your current landowner agreements. I would therefore be grateful for confirmation that where necessary new agreements have been issued and signed by both parties. In other words they don’t or didn’t have an agreement to charge a motorist. But our beloved DVLA allowed it and further more only ask for an email to confirm they now have the authority from the land owner but have they? Watch this space the plot thickens.
