Hi Mr. Lentz We (me and my pregnent wife Keeda Wood-Hamilton (married jan) and her 12 year old son) are currently in a situation that may be a little over our heads and need a little advice or push in the right direction.. and also is quite urgent as we already have had 3 eviction attempts from the council via the court with a posession order. My wife first moved into 87b bravington road Westminster in 2007 because she had nowhere to live. It was a council flat under the tenancy holder Albert Prosper who she met through a mutual friend, all was fine and she helped him with his living arrangemants as he was not so well. Sadly in 2010 Mr Prosper passed. During that period A council woman turned up to the address and unexpectedly met Keeda, she brought her to the office to interview her to see if was eligible to succeed tenancy, after that she said they would be in touch shortly. Some time passed my wife began to receive Rent statements with her name on it saying she was in arrears in excess of £2000!! Note that she had not signed any type of agreement, only had an interview to about her status. Nether the less she made an effort to pay... she had no method of payment btw, but she managed to get hold of a rent card from a nice woman at the council office and started making payments of what she could.. there were some times where she could not keep up as she was not working but tried her best. It finally reached a stage where she received a notice to quit, at that point she got in touch with TV edwards a solicitor to represent her. In short; it was a very long and drawn out thing where a lot of legalise was used and she basically trusted the solicitor due to a lack of understanding. In november 2012 The solicitor did some calculations and concluded that she clear roughly £2000 of £9000 in arrears before a certain date and they would allow her to stay.. the catch was: that after june 2013 whether or not she had paid, the council would seek another possesion order.. Which is what is happening presently in the form of a consent order that they they say the solicitor signed as her representative. Since then we have had a Mckenzie friend in court to stay the 1st eviction but she failed to persue and no longer represents her (dont think she knew what she was doing!). Now the council says she has no LEGAL right to the property and refuses to rehouse her, they have advised her to leave and go to the housing office and go into temporary accomodation till god knows when. They keep producing the same warrant: a stamped piece of paper with no judge signature on it!...,even one time not even adressed to her!!!!! We have copies! A family member who worked for a council told me that once they started taking payment from her without clearly specifying in writing that this NOT rent but use and occupy (all she has is rent statements) that they have in effect created a new tenency. ALSO we can clearly see that on the rent statements that her Housing Benefit has paid the council TWO seperate lump sums of £6000 and £14000 within a period of ONE WEEK!! Some of these payments were also going into the Deceaseds Account!! She is 3 months pregnant and son in 1st year of highschool with a Scholarship to Latymer Upper and I am in my final year of Electrical installation...this situation is taking its toll on all of us! WE have been studying the Lawful and Legal routes and wish to stand as a man or woman in a Queens bench court or other effective means... But if I am to make any type of representation in a court I would prefer that I have all my angles covered and know what I am doing and where to go.. hence why I am sending this message far and wide, not just here. WE have had 3 visits from the bailiff, luckily the last 2 we had help from friends to block the way as they came with police and tried to force their way and failed. My wife (Keeda Wood) still pays her rent and has paid off the arrears (in my view that was not even hers!) and yet the council refuse her offers for them to rehouse her or give her a new tenancy.... I dont see HOW somebody can owe something that they never signed or made an agreement in the first place! Something is not right her Guys I need all the input and help we can get! If what Roger Hayes and others say is right about the collusion of the council and the courts with these illegal warrants, I am sure this could be used easily as a landslide case. Please any input would be helpful.
